Decision:

As Mr Cameron admitted the breach the charge was found to be proved. 

Penalty:

Accordingly we impose a suspension on Mr Cameron from riding in races to start after racing on the 19th February 2011 and to conclude after racing on the 2nd March 2011 (7 riding days). In addition we impose a fine of $500.

Charge:

Mr George alleged that near the 300 metres Mr Cameron rider of (INSURGENT) shifted out and hampered SHIBBOLETH (V Colgan) which shifted out and checked DATING (J McDonald). 

Facts:

Mr Oatham demonstrated the video films using all three angles. The head on film showed Mr Cameron was racing adjacent to the running rail nearing the 300 metres when he shifts out when not sufficiently clear and makes contact with SHIBBOLETH on three occasions who became unbalanced and shifted out crowding DATING who received notable interference.
Mr Cameron while admitting the breach said he was travelling well at the time and thought the gap was there as SHIBBOLETH was stopping. He admitted when viewing the films he did not have the right to come out when he did which resulted in tightening to two runners.

Submissions for Penalty:

Mr George said that Mr Cameron had incurred a suspension for careless riding of 7 days in December and 4 days in August last year. He said the carelessness was in the mid range however, the severity was mid to high. He said this was a Group 2 race and the chances of DATING were impeded. He submitted a suspension of greater than 5 days and for the committee to consider a fine of $500.00 because of the status of the race and the prize money earned by INSURGENT.

Mr George confirmed Mr Cameron is a national rider.

Mr Cameron said he had firm riding commitments at Ellerslie on 19th February 2011.

Reasons for Penalty:

The committee carefully considered all evidence and submissions presented. Mr Cameron’s only mitigating factor is his admission of the breach. The aggravating factors are his average riding record, the level of carelessness which we consider to be mid range however the interference suffered by DATING was in the mid to high range. The committee is very mindful this was a Group 2 race for a stake of $100,000 in which INSURGENT was placed 2nd by gaining an advantage when shifting out.  For these reasons we agree that a suspension must reflect that and accept a fine is warranted. We accept that Mr Cameron is a national rider and grant a 7 day deferment to his suspension. We informed Mr Cameron that our records show he had incurred a suspension on the 5th June 2010 for 4 days which makes this his 4th charge in the last 8 months.
