As Ms Myers admitted the breach the charge was found proved.

Penalty:

Ms Myers' Jockey's Licence was suspended from the close of racing on 6 November up to and including 11 November 2013 (4 days).

Facts:

Following the running of Race 3, Lisa Latta Racing Stables 3yo Maiden 1200m, an information was lodged with the judicial committee alleging a breach of Rule 638(1)(d) in that Ms Myers allowed her mount to shift in soon after the start when not clear, resulting in checks to other runners, including FIVE TARTS which clipped heels and blundered.

Rule 638(1)(d) reads:

“A rider shall not ride a horse in a manner which the judicial committee considers to be careless”

The rule was read and Ms Myers acknowledged that she understood the rule and the charge preferred against her and confirmed that she admitted the breach.

The incident occurred soon after the start and the films showed Ms Myers and her mount SATANYA shifting in when not sufficiently clear of DANNY BOY (L Whelan), QUEEN OF UR (D Walker) and FIVE TARTS (S Doyle). This shift resulted in FIVE TARTS being severely tightened and as a consequence the horse blundered and lost valuable ground. Mr Goodwin who showed the films said that DANNY BOY did not help the situation by over-racing.

Ms Myers for her part said that she did shift in when not clear but believed that DANNY BOY contributed to the incident due to its racing manners.

Submissions for Penalty:

Mr Whiterod said that Ms Myers had a good record in that she had only been suspended once this year (13 April – 6 days). He submitted that the carelessness was in the mid-range.

Ms Myers said that she was aware that some riders had been suspended and fined to allow them to ride at major meetings and she requested that the same consideration be given to her to enable her to fulfil important engagements at the upcoming Canterbury meeting. Ms Myers asked that any suspension start immediately.

The chair asked Co-Chief Stipendiary Steward Mr Neal for his views on this matter and he said that he was aware that some JCA committees had imposed such penalties but said that the RIU did not advocate such practice.

Reasons for Penalty:

The committee took into account all of the submissions and adopted as a starting point a period of 5 days suspension. Due to Ms Myers' very good record and the admission of the breach and that the carelessness was in the mid-range the committee determined that a 4 riding day suspension was an appropriate penalty.
