The breach is admitted and therefore we find the charge proved.

Penalty:

This Committee orders that Miss Sim's Riders Licence is suspended from the conclusion of racing on the 3rd of February 2018 until after the conclusion of Racing on the 11th of February 2018 (5 National Riding days).

Facts:

Following the running of the O'REILLY'S MOTEL MATAMATA an Information was lodged by Stipendiary Steward Mr A Coles against Apprentice Jockey Miss A Sims alleging that Miss Sims the rider of GEORGIAN EASE allowed her mount to shift in near the 100 metres mark when not sufficiently clear of ELUSIVE BOLT which was checked.

Rule 638(1)(d) provides : a Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Miss Sims was present at the Hearing and she advised the Committee that she admitted the breach. Miss Sims was supported by Mr N Harris the Apprentice Jockey Mentor.

Stipendiary Steward Mr W Robinson demonstrated the incident by use of the race films. He identified GEORGIAN EASE racing outside ELUSIVE BOLT (Rider T Thornton) and INTO THE GROOVE (Rider M Cameron) . He said that there was slight outward movement by INTO THE GROOVE but it was straightened immediately . He then showed where GEORGIAN EASE was shifting in and Miss Sims continued to ride her mount forward with the whip. It continued running in and in doing so checked ELUSIVE BOLT which was on the inside. He added that Miss Sims was never the required distance clear of ELUSIVE BOLT when she allowed her mount to shift inwards.

Miss Sims acknowledged that the films were self explanatory. She did say that her mount was "heavy headed" and that it was lugging in after a hard run. She did acknowledge that she did not make a conscious enough effort to straighten it up.

Mr Harris said that the films were very clear and that Miss Sims hadn't stopped riding soon enough. Mr Harris said that although Mr Cameron's mount came out slightly ELUSIVE BOLT was squeezed as a result of Miss Sims shifting in.

Submissions for Penalty:

Mr Coles said that Miss Sims had a very good record and had not had any breaches of this Rule in the last 12 months. He said that GEORGIAN EASE was inclined to lay in and that Miss Sims tried to straighten it but she continued to ride with the whip.

He said that Miss Sim's overall record was very good and he described the breach as being low end carelessness. He submitted that a suspension of 6 national Riding days would be an appropriate starting point.

Miss Sims agreed with the Steward's penalty submissions.

When asked by the Committee she said that she did not have any immediate riding engagements and that her suspension could begin immediately.

Reasons for Penalty:

The Committee carefully viewed the race films which show the incident very clearly. We also considered the submissions of the parties.

The aggravating factor (which we explained to Miss Sims) was the fact that she continued to ride forward with the whip when her horse continued to shift in. We also pointed out to her that she was not the required distance clear when she moved in. We explained to Miss Sims that we were concerned about both of these factors.

We do however agree with Mr Coles that the incident was low level and we have taken this into account. We give Miss Sims credit for her admission of the breach (which was unsurprising given the compelling video evidence) and we certainly give her credit for her very good record.

We have adopted a starting point of 6 National Riding days for low level careless riding. We have given Miss Sims a 1 day reduction for her admission of the breach and her very good record.

Taking all matters into account we believe that a suspension of 5 National Riding days is appropriate. We have advised Miss Sims that we have not taken racing on the 3rd of February into account because Riders for those meetings have already been declared.
