Penalty:
The Committee granted Mr Jones’ request to a deferment pursuant to Rule 1106(2).
Accordingly, Mr Jones’ had his license to ride in races suspended for a period to commence after racing on 8 June and conclude after racing on 15 June 2019.
Facts:
Following the running of race 7, OMF 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Jones permitted his mount HAY TIGER to shift inwards near the 1200 metres when not sufficiently clear of SWEET NINETEEN (S Collett) which was hampered losing ground.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Jones said he understood the Rule and confirmed that he admitted the breach.
Mr Oatham demonstrated the incident using the available video footage. He identified that Mr Jones allowed his mount to shift in when no more than 1 length clear of SWEET NINETEEN. He said in doing so Mr Jones placed pressure on Ms Collett for some distance which resulted in her having to take a hold of her mount and relenting her position.
Mr Jones admitted that he allowed his mount to shift inwards near the 1200 metres when insufficiently clear of SWEET NINETEEN. However, he identified on the video films that when he was shifting inwards NO LOITERING shifted out 1 horse width and this contributed to the incident. He added that all horses were racing well away from the inside running rail.
Submissions for Penalty:
Mr Williamson produced Mr Jones’ record which showed 2 previous breaches under this Rule in the last 12 months. The most recent being 30/12/2018 which resulted in a 5 day suspension. He said Mr Jones’ record was better than average and to his credit he admitted the breach. Mr Williamson described the level of carelessness as low range.
In response to a question from the Committee, Mr Oatham advised that Mr Jones has had 145 race day rides in the last 12 months.
Mr Jones initially told the Committee that any proposed suspension could start immediately. However, prior to the close of the Race Meeting Mr Jones sought a rehearing regarding an amendment to his suspension dates. This was granted by the Committee under the provisions of Rule 923(2). Mr Jones made a new request to the Committee for a 7 day deferment to his suspension so he could ride at Te Rapa on 8 June.
Reasons for Penalty:
The Committee considered all the evidence and submissions presented.
It was clear on the video films that Mr Jones permitted his mount to shift inwards near the 1200 metres when only ¾ of a length clear of SWEET NINETEEN. As a result that runner lost its rightful running line when hampered. We deemed NO LOITERING’s contribution to the incident was minor. The Committee deemed the level of carelessness displayed by Mr Jones was low range.
The JCA Penalty Guide starting point for low range carelessness is 6 national days which we adopted.
There were no aggravating factors that warranted an uplift in penalty.
We considered Mr Jones’ record to be average and a neutral factor.
The mitigating fact was Mr Jones’ admission of the breach. For this he was afforded a 1 day reduction in penalty.
We note the Stipendiary Stewards had no objection to Mr Jones’ request for a 7 day deferment to his suspension.
After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
