This Committee imposes a fine of $350.00 on Mr Pike.

Facts:

Following the earlier decision to decline consent to late scratch INTRIGUE from Race 9 Mr T Pike by his representative Mr Dean Williams proceeded to late scratch his horse anyway. Mr Pike is now charged with late scratching a horse without having permission to do so.

Mr Williams had indicated on the Information that he did not admit the breach and when asked by the Committee if he believed he had consent he was unable to offer any explanation. The Hearing proceeded on the basis that the breach was admitted.

Submissions for Penalty:

In respect to penalty Mr Oatham referred to recent charges under this Rule and said that penalties seemed to be fines in the order of $300.00 to $400.00. He referred to a recent decision at the Wellington Racing Club when Trainers D & E Haworth were fined $300.00. He said that the Trainers in that case were completely accepting of the decision but that was not the case in the present situation. He believed that any fine should be greater than that one.

Mr Williams did not make any submissions.

Reasons for Penalty:

The Committee checked the JCA Guidelines which provide for a starting point penalty of a $200.00 fine . We have also checked previous penalties particularly the recent one referred to by Mr Oatham. We have taken into account the fact that this is a Premier day and also the lateness of the application.

We believe that based on the above and also the penalty submissions made to us that a fine of $350.00 is appropriate.
