Facts:
Following the running of race 4, Lion Red, an Information was filed pursuant to Rule 330 (3)(c). The Informant, Mr Williamson, alleged that Ms Farr failed to make the declared weight for LE MOUSSIER.
Ms Farr acknowledged that she understood the Rule and confirmed her admission of the breach. Mr N Harris assisted Ms Farr at the hearing.
Rule 330(3)(c) provides: “A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.
Mr Williamson advised that Ms Farr was unable to make the weight for LE MOUSSIER and was replaced by Mr J Nason. He added that Ms Farr has subsequently raised her claiming weight from 54.5 kgs up to 55.5 kgs.
Ms Farr said that she was able to ride at 54kgs last week but has since had difficulty losing any weight. She advised that she had put on extra weight this week.
Mr Harris was of the view that Ms Farr had to get the correct balance between riding on the flat versus Highweight and Jump riding.

Mr Williamson said that Ms Farr had breached this Rule in February and April this year where she was fined the sum of $100 and $200 respectively under the Minor Infringement System. He said he had some sympathy for Ms Farr as she was going through a difficult patch with her weight. However, he said that Ms Farr had an obligation to make sure she could ride a horse at the weight which it was handicapped to carry. He submitted a fine of at least $200 but not more than $300.
Ms Farr had nothing to add.

Ms Farr has appeared before the Judicial Committee because she breached the overweight Rule for the third time within a 120 day period.
The Committee reminded Ms Farr that it was important for her to inform her employer the current situation with her weight.
The Committee had regard for other similar breaches of this Rule when determining an appropriate and consistent penalty.
