As Ms Spratt admitted the breach the charge was found proved.

Penalty:

Taking into account all of these factors Ms Spratt is suspended from riding from the close of racing on Saturday September 24th up to and including racing on Friday September 30th. This equates to four riding days as Ms Spratt confirmed to the committee that she would not have accepted rides at the South Canterbury meeting on Monday September 26th so this day was not included in the suspension.

Charge:

Following the running of Race 4, the New Zealand Bloodstock Insurance 1300, an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1) (d) in that passing the 900m S Spratt the rider of NEWYORK BAKERBOY permitted her mount to shift in when not clear of CONTEST which was tightened and checked.

Facts:

Mr Goodwin gave his interpretation of the incident using both the head and side on films. There were four horses across the track with Ms Spratt in a four wide position, Mr Collett to the inside of her on CONTEST and Mr Bosson was the inside runner. Ms Spratt moved inwards when not clear of Mr Collett who had to ease his mount. She went from being four horse widths off the rail to one horse width off. Mr Bosson was seen to move outwards as well but this was prior to Ms Spratt’s inward movement and did not contribute to the incident.
 
Ms Spratt said that she was almost clear and that the incident looked worse because Mr Collett’s mount threw its head in the air when he eased it back. She also mentioned Mr Bosson moving outwards which may have contributed to the tightening.

Submissions for Penalty:

Mr Oatham said that Ms Spratt had a good record with 2 suspensions for careless riding in the previous 12 months on 5/2/11 and 9/3/11. He said that she was never sufficiently clear of Mr Collett when she moved inwards putting him in an awkward position however he did concede that the racing manners of CONTEST may have contributed to the degree of interference. The Stewards considered the offending to be at the lower end of the scale.

Ms Spratt had nothing to add in regard to penalty submissions but did advise the committee that she would be riding at Ellerslie on Saturday September 24th.

Reasons for Penalty:

In coming to a decision on penalty the committee considered all of the submissions. We took into account Ms Spratt’s admission of the breach, her riding record which, considering how many rides she has is very good and the degree of carelessness. Ms Spratt misjudged her distance when looking for a run closer to the rail and was not clear of Mr Collett when she moved inwards. Mr Collett eased back as a direct result of Ms Spratt not being the required two lengths clear of his mount. The interference suffered by Mr Collett’s mount was not severe and his horse did throw its head around when being eased which made the incident look worse than what it was. The committee considered Ms Spratt’s carelessness to be low.
