Breach of rule 857(7)(g) failure to maintain position behind mobile gate.

Facts:

An Information was lodged by Stipendiary Steward Mr N G McIntyre against driver Mr T Macfarlane alleging that Mr Macfarlane as the driver of SUPREME GEM failed to maintain his position behind the mobile gate.

Rule 857(7)(g) provides: no horseman shall fail to come up into and/or maintain his position.

Mr Macfarlane was present and advised this Committee that he admitted the breach.

Mr McIntyre demonstrated the incident by use of the video films which showed that Mr Macfarlane drew barrier 6 but in the scoreup he was not up on the barrier and at the point of dispatch he was at least 2 lengths from the mobile barrier.

Submissions for Penalty:

Mr McIntyre advised  that the JCA Penalty Guidelines provided for a starting point penalty of 5 Drives or a $250.00 fine.

He also advised that Mr Macfarlane had a good record but he pointed out that this was a Group 1 Race.

Mr Macfarlane said it was a misjudgement on his part and that he was trying to get up behind the barrier. He pointed out that he did not interfere with any other horse nor did he gain an advantage by being back from the barrier.

Reasons for Penalty:

The films show the incident clearly and the charge is admitted.

The Committee pointed out to Mr Macfarlane that the Penalty Guidelines are for standard races and for a Group 1 Race the Committee would view the starting point as being in excess of $300.00.

In this instance however the Committee gives Mr Macfarlane credit for admitting the charge and he also is given credit for his good record.

The Committee believes that a fine of $250.00 is appropriate.
