Charge:
Miss Chilcott was charged with driving 'Mary Anastasia' carelessly in race 4 when she shifted inwards going into the first bend, causing a check to Souvenir Glory which in turn caused interference to Maddy’s Star.
Facts:
Miss Chilcott appeared for the hearing and confirmed her admission of the charge. She consented to evidence adduced at an earlier protest hearing into the same race be admitted for this hearing.
Footage of the early stages of the race clearly showed Miss Chilcott driving 'Mary Anastasia' moving inwards on 'Souvenir Glory' (B Holmes) racing into the first bend. Mr Holmes called for room but was tightened for room and forced onto 'Maddy’s Star' ( T Grayling) which broke.
Side on video footage established that Miss Chilcott was not sufficiently clear of the inside horses when she moved inwards.

Mr Ydgren told the committee that Miss Chilcott was a very experienced driver who had a total of 172 drives so far this season and about 400 the previous.
She had two previous breaches in the past 12 months and had a good record. The breach was mid range although there were consequential effects to other runners as well as her horse which was subsequently relegated from 3rd to 10th place.
The guidelines indicated a starting point of 10 drives or $500 fine but he submitted a fine of $300 was appropriate
Miss Chilcott had no comment to make.

Mitigating factors in Miss Chilcott’s favour include her admission of the breach, her driving record and our assessment of the breach as mid range in seriousness.
The consequential effect of her actions on other runners and her own horse were aggravating factors.
