As the charge was admitted, the committee found the charge proved.

Penalty:

Mr Bradley is suspended from the conclusion of racing on Saturday 18 February until the conclusion of racing on Saturday 25 February. This is a total of four (4) days and incorporates the Poverty Bay (19th), Wairoa (23rd), Canterbury (24th) and Otaki (25th) meetings.

Facts:

Following the running of Race 6 (WENHAM GRAIN & SEED HANDICAP 2100m), Information A7696 was filed with the Judicial Committee. It alleged a breach of Rule 638(1)(d) by Licensed Rider Mr Darryl Bradley. The Information alleged that he: ”angled his mount COOL TART outwards when not sufficiently clear of SANJARA passing the 200 metres”.

Rule 638(1)(d) states:
“A Rider shall not ride a horse in a manner which the Judicial Committee considers to be: … (d) careless.”

Mr Bradley confirmed to the committee that he understood Rule 638(1)(d), and that he admitted the breach.

Using the available head-on and side-on films, Mr Balcombe identified Mr Bradley (COOL TART) racing to the inside of Mr Elliott (SANJARA) soon after turning for home. Mr Goodwin stated that while Mr Bradley had been held up, a run to his inside that had been presented had closed and that Mr Bradley’s alternative action was to angle his mount to his outside. In doing so, he had caused interference to SANJARA. Mr Goodwin believed that Mr Bradley was attempting to be competitive, and while SANAJARA was admittedly a tired runner, the preferred action would have been for Mr Bradley to take a hold instead. After speaking to Mr McKay, Mr Goodwin placed Mr Bradley at approximately ¾ length clear at the time of the interference.

Mr Bradley agreed with Mr Goodwin and said that early in the home straight his horse had sought a run, but that COOL TART was not good enough. He knew SANJARA was to his outside for most of the race, and had thought it had weakened and dropped off, but that this was not the case and he was simply not the required distance clear. He described it as an error in his judgement.

Submissions for Penalty:

Mr Goodwin described Mr Bradley’s record as a very good one for a busy rider. He advised of two previous breaches (29 October; Feilding - 4 days and 3 September; Wanganui - 4 days). He placed the level of carelessness at below the mid-range as while Mr Elliott was weakening at the time, Mr Bradley had taken a wrong option. He submitted a period of suspension as appropriate.

Mr Bradley advised of upcoming commitments at Taranaki on Saturday 18 February and sought a deferment to accommodate those commitments. He said that he regularly rode in the South Island, having ridden at Wingatui within the last week. He had also been contacted by trainer Danny Crozier who wished to engage him for Canterbury meetings. Mr Goodwin advised that the stewards had no issues with the upcoming Canterbury meeting being included in a period of suspension.

Mr Bradley also advised the committee that he had no intention to ride at the upcoming Avondale meeting. 

Reasons for Penalty:

The committee considered all of the submissions placed before it. The head-on film clearly established that COOL TART angled out early in the home straight causing interference to SANJARA. Whether that horse was weakening or not is irrelevant as it was entitled to be there and Mr Bradley should not have moved across until the required distance clear. The committee assess the level of carelessness to be at the low-end and accept that Mr Bradley has, in his own words, erred in his judgement. He should have, instead, taken a hold of his mount. We believed that a period of suspension was an appropriate penalty to impose on this occasion, and adopted the JCA Penalty Guidelines suggested starting point of five days. In mitigation, the committee considered Mr Bradley’s early admission of the breach and his very good record. We decided that a four day period of suspension would be appropriate. The committee consented to a deferment of the suspension in order to allow Mr Bradley to fulfill riding engagements on Saturday 18 February at New Plymouth. We also appreciated Mr Bradley’s honest approach to advising the committee of his regular pattern of riding to ensure that the period of suspension incorporated genuine race days.
