Mr McIntyre produced the defendant's record, which showed that he had been suspended from driving for 7 driving days for a breach of this rule on 20 June last. Mr McIntyre estimated the defendant had had some 170 drives since this time without being in breach of the rule. He submitted that a fine of $200 was appropriate.
Reasons for Penalty:
The defendant has used his whip some 23 to 24 times in the straight. In mitigation is the fact that he has broken his actions up and there were no quick fire strikes.
We give credit to Mr Butt's immediate admission of the breach once he had been spoken to by Mr McIntyre and had viewed the video.
Mr Butt has 3 pevious breaches of this rule this last year. His record is thus poor. In his favour, however, is that he has driven since August 170 plus times without being in breach. We also take into account that he is a junior driver.
