We rule that the meeting be abandoned. 

Facts:

Following the running of Race # 1, the STEVEN PRINCE RACING STABLES 2YO, Mr Davidson sought a ruling whether the meeting should be abandoned due to the unsafe nature of the track. 

Submissions for Decision:

Mr Lawrence, the President of the Otago Racing Club, spoke and said the two year-old that had fallen in the first, CENT HIGH, had never become balanced after clipping heels. He believed this was the reason that that horse fell and not because of the condition of the track.

Mr Kennedy, represented the trainers, and said in his opinion although there were several slip marks on the track these did not indicate there had been sideways movement. He said he had had considerable experience as a jockey and he believed the track was safe to ride.

Mr Bradley, Mr Walsh and Mr Moseley, together with Ms Williams, had inspected the track. They all said that they believed the track was unsafe and Mr Bradley and Mr Walsh both said they would not ride as a consequence. Mr Moseley was of a similar view although he was less vocal. Ms Williams agreed with Mr Bradley and Mr Walsh. The jockeys were of the view CENT HIGH had regained her balance before losing her back legs. They put this down to the state of the track, which they believed had dead grass hindering the water filtering through beyond the upper surface.

Mr Davidson said he also had issues with the track and had been surprised at the number of marks when he inspected the track. He supported the jockeys’ concerns, stating if there was a health and safety issue the meeting should not proceed.

Having listened to the parties we are satisfied that the jockeys’ concerns regarding health and safety issues are genuine and well-founded.
