Following the running of Race 2 (Stoney Creek Butchery Mobile Pace) Information No. A10271 was filed with the Judicial Committee. It was alleged by the Informant that Mr Heaton used his whip on more occasions than permitted on CONTRACTUAL ISSUES inside the final 400m.
Mr Heaton said that he was aware of the Rules and confirmed that he admitted the breach.
Mr Muirhead showed the film replays and said that Mr Heaton used his whip 14 times on CONTRACTUAL ISSUES inside the final 400m which was 4 strikes over the accepted number of 10 strikes.
Mr Heaton agreed with Mr Muirhead’s interpretation of his whip use.
Submissions for Penalty:
Mr Muirhead said that Mr Heaton had a good record and submitted that the JCA Penalty Guideline of a $300 fine for 14 strikes would be a suitable penalty.
Mr Heaton did not have anything to say on penalty.

The Committee was satisfied that Mr Heaton used his whip on no fewer than 14 times inside the final 400m. Albeit Mr Heaton admitted the breach a discount from the JCA starting point of $300 was not afforded as it was inevitable that the charge would have been upheld.
