Mrs Satherley's licence is suspended from the close of racing on Friday 8 January up to and including racing on Saturday 16th January. This incorporates the Auckland (9th), Wanganui (14th), Matamata (15th) and Tauranga (16th) meetings.
Facts:
Following the running of Race 2, (NZB Insurance Pearl Series Race 1400m), Information A6830 was filed with the Judicial Committee. It alleged a breach of Rule 638(1)(d) and stated that "Rider L Satherley permitted her mount POLAR SECRET to shift inwards near the 400 metres when not the required distance clear of PROMISE TO PAY (R Jones) which was checked.
Mrs Satherley confirmed she understood the rule and that she admitted the breach.
All available films were viewed during the hearing. Using the head-on film, Stipendiary Steward, Mr Tidmarsh identified POLAR SECRET approaching the 400 metres. He pointed out Mrs Satherley attempting to go for a marginal run when a gap was presented to the inside of GARDENIER (J Parkes). That horse then commenced a slight inwards movement when POLAR SECRET moves closer to the running rail when not the required distance clear. This movement resulted in a sharp check to PROMISED TO PAY.
Mrs Satherley indicated that the incident was self explanatory and she had no comments to make.
Submissions for Penalty:
In presenting Mrs Satherley's record, Stipendiary Steward, Mr Goodwin identified that she had no breaches of this rule over the previous 12 months period. He identified the mild inwards movement from Mr Parkes as having some bearing on penalty as a marginal gap had been initially presented. He described the severity of the interference to Mr Jones' as "Bad", and submitted that this ought to be considered when determining penalty. He submitted a period of suspension as appropriate.
Mrs Satherley advised the committee that she had commitments at the Rotorua Meeting on 8 January and sought a deferral of any period of suspension to allow her to fulfill those commitments. She had recently returned to race day riding some 2 1/2 months ago as a result of being sidelined for a period of seven months due to injury. She stated that she resided in Cambridge and had regularly ridden in the Central Districts prior to her injury. Looking at upcoming race meetings, she believed the Wanganui Meeting on 14 January should be included within any period of suspension.
Mr Goodwin had no opposition to Wanganui's inclusion in a period of suspension.
Reasons for Penalty:
The Committee considered all of the submissions placed before it and determined that a period of suspension was appropriate; adopting a five day starting point. In mitigation we applied Mrs Satherley's very good record, her early admission of the breach and the effect that Mr Parkes' inwards movement immediately prior to this incident had on the actions taken by Mrs Satherley. We independently assessed the level of carelessness to be placed at the mid-range. Mrs Satherley went for a marginal gap, shifting inwards when not sufficiently clear. This led to a sharp check to PROMISE TO PAY which was clearly visible on the head-on film.
On balance we considered a four day period of suspension as appropriate. When determining the inclusion of upcoming race meetings we accept that Mrs Satherley has recently returned to raceday riding after an injury. Based on the evidence placed before us we determined that the Wanganui Meeting on 14 January should be included in her suspension period.
