We find the charge proved.

We impose a fine of $200 and remind Mr Williams of his professional obligations.
Charge:
Mr Allison alleged that Mr Williams drove carelessly when allowing DEL SUR to strike a pylon, which caused DEL SUR to break.
Facts:
Mr Allison demonstrated on all the available videos that the respondent, as he entered the home straight, went for a run on the inside of the horse being driven by Mr Dunn, which he was trailing at the time. In so doing, Mr Williams came into contact with the last of the pylons before the passing lane. DEL SUR almost fell.
Submissions for Decision:
Mr Allison demonstrated with reference to the horse’s head that it was turned inwards and that respondent was looking for a run on the inner of Mr Dunn’s horse, which was starting to tire.
Mr Williams said his horse had not struck the pylon. He believed he was still outside the pylon when his horse had tried to jump over it. He acknowledged he had got a bit close to the pylon but he believed DEL SUR legs were still behind the cart of Mr Dunn at the time.
Reasons for Decision:
We are satisfied that Mr Allison’s description of events is correct. Mr Williams in looking for a run on the inside of Mr Dunn has simply misjudged the position of the last pylon before the passing lane and has come into contact with the pylon. The result was that DEL SUR attempted to jump the pylon and galloped. We are further satisfied that a prudent and careful driver would have waited before taking a run on the inside of Mr Dunn and in so doing, would not have into contact with the pylon in the manner of Mr Williams.
Submissions for Penalty:
Mr Allison produced the respondent’s record, which was clear under this rule for the past 12 months. He explained that Mr Williams was establishing himself in Southland, having moved from Christchurch, and submitted a fine of $250 was appropriate.
Mr Williams asked that the fine be as small as possible.
Reasons for Penalty:
We note that Mr Williams has had 78 drives so far this season and 267 in the past season. His clean record is thus a credit to him. We are satisfied it is just a matter of misjudgment on his part when looking for a run on the inside of Mr Dunn. He has caused interference to no horse other than his own. The weather conditions at the time were atrocious and we believe this may have been a factor that led to this misjudgment.
