As Mrs Allpress admitted the breach the Committee found the charge proved.
Penalty:
The Committee granted a deferment to Mrs Allpress’ suspension pursuant to Rule 1106(2).
Accordingly, Mrs Allpress had her license to ride in races suspended for a period to commence after racing on 4 May and conclude after racing on 18 May 2019.
Facts:
Following the running of race 7, Travis Stakes (Group 2), an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mrs Allpress directed her mount (JESSIEGEE) inwards when not sufficiently clear of TANTALISING which was checked when placed in restricted room near the 300 then continuing to shift inwards crowding LADY PAINTON which was checked near the 250 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mrs Allpress said she understood the Rule and confirmed that she admitted the breach.
Mr Coles demonstrated the incident using the available video footage. He identified that Mrs Allpress permitted her mount to shift inwards near the 300 metres when only 1 length clear of TANTALISING. As a result that runner was checked when placed in restricted room. He said that Mrs Allpress then continued to ride her mount forward on an inward movement. In doing so LADY PAINTON was crowded and checked near the 250 metres.
Mrs Allpress said she didn’t realise that she had 2 runners on her inside near the 300 metres. She said that she made a bad decision in allowing her mount to shift inwards which resulted in 2 horses being checked.
Submissions for Penalty:
Mr Oatham produced Mrs Allpress’ record which showed 4 previous breaches under this Rule in the last 12 months.

9/2/2019 – 5 days
17/3/2019 – 6 days.
He said that with some riders 5 breaches in 12 months would be a bad record but given that Mrs Allpress has had 783 rides during that period he considered her record to be a neutral factor. He said 2 horses were affected as a result of Mrs Allpress’ carelessness and he described the level of carelessness as mid-range. In conclusion he submitted that the Committee needed to consider the breach occurred in a Group 2 race worth $100,000.
Mrs Allpress advised that she had firm engagements up to and including 4 May and sought a 7 day deferment to her proposed suspension.

The Committee considered all the evidence and submissions presented.
It was evident on the video films that Mrs Allpress allowed her mount to shift in on 2 occasions in the final straight when not sufficiently clear to do so. As a consequence TANTALISING then LADY PAINTON suffered interference. We deemed the level of carelessness displayed by Mrs Allpress to be mid-range.
The JCA Penalty Guide starting point for mid-range carelessness is 8 days which was adopted.
While we accept that Mrs Allpress is a busy rider there was some concern that this is her 3rd careless riding breach in the last 3 months and her 5th in the last 12 months. We considered this to be an aggravating factor which warranted a 1 day uplift in penalty.
Under the provisions of Rule 920 (2) we applied a further 2 day uplift because the breach occurred in a Group 2 race with stakes payable of $100,000.
The mitigating factor was Mrs Allpress’ admission of the breach and she was afforded a 1 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 10 national riding days.
