Mr O’Malley’s Apprentice Jockey’s Licence was suspended from the close of racing on 26 January up to the end of racing on 6 February 2019.
Facts:
Following the running of Race 2 (Aquashield Roofing 1200) Information No.A9240 was filed with the Judicial Committee. It was alleged by the Informant that Mr O’Malley allowed his mount to shift inwards in the back straight when not clear of PRESS RELEASE.
Mr O’Malley acknowledged that he understood the Rule, the Charge and confirmed that he admitted the breach.
Mr Goodwin showed the film replays and said that Mr O’Malley allowed his mount to shift in when not clear of PRESS RELEASE which was checked. He said that after being checked PRESS RELEASE was inclined to over-race. He concluded by saying that Mr O’Malley and his mount was only one length clear when shifting inwards.
Mr O’Malley said that he should have let his horse race on a bit more before he shifted.
Ms Clapperton on behalf of Mr O’Malley said that he did not let it roll on far enough before crossing and that Mr O’Malley did look at least four times to his inside. She added that Ms Collett the rider of PRESS RELEASE had said to her that the incident looked worse than it actually was as her horse would not come back under her when being restrained.
Submissions for Penalty:
Mr Balcombe said that Mr O’Malley had a very good record with only one suspension imposed for careless riding in the last 12 months, that being in September 2018 when the penalty was a 6 riding-day suspension. He said that Mr O’Malley did look to his inside and that it was misjudgement on his part. He placed the carelessness in the low-range and submitted that a term of suspension be imposed.
Ms Clapperton said that Mr O’Malley’s record was excellent and that he had riding engagements at Wellington on 26 January.

The Committee independently determined that the careless riding was in the low-range category.
The JCA starting point for such carelessness is a 6 riding-day suspension. Taking into account the admitted breach and good record the Committee deemed that a 5 riding-day suspension was a suitable penalty.
