As Ms Spratt admitted the breach we find the charge proved.

Accordingly, we impose a $225 fine on Ms Spratt.
Charge:
Following race 7, an information was filed pursuant to Rule 638(3)(b). The informant, Mr Coles, alleged that Ms Spratt used her whip in an excessive manner prior to the 200 metres on her mount ERIS.
Facts:
Mr Robinson demonstrated the incident on the video films. He said that Ms Spratt used her whip 14 consecutive times which was outside the requirements of using the whip 6 times then stopping for 6 times before using the whip again.
Ms Spratt said her mount was lazy.
Submissions for Penalty:
Mr Coles produced Ms Spratt's record which showed 1 previous breach under this rule in the last 12 months. This occurred on December 22 and resulted in a $150 fine. He said Ms Spratt should be given credit for her admission of the breach and submitted a fine in the $200 to $300 range.
Ms Spratt submitted that prior to December 2012 she had a clear record for 18 months. She submitted the race was worth only $7,000 and her recent penalty was on a premier day.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented. The mitigating factors are Ms Spratt's admission of the breach, we assess the number of strikes and severity to be low end. The aggravating fact this was Ms Spratt's 2nd breach in a short period of time.
The committee did inform Ms Spratt that the JCA penalty guide for this breach recommended a starting point of a $500 fine or 2 days suspension. We referred to similar breaches under this rule before determining penalty. We explained to Ms Spratt that we assess an appropriate penalty is a $225 fine after placing emphasis on the mitigating factors.
