Facts:
Following the running of Race 5, the “Denniston Dog” Café & Bar (Westport) Pace, an Information Instigating a Protest was filed by Stipendiary Steward Mr N. M. Ydgren against the 2nd placing of “Onslow Hanover” (5), by “Revell Yell” (11) which finished 6th in the race.
The Judge’s placings in this race were as follows:
1st – Special Bella (16)
2nd – Onslow Hanover (5)
3rd – Unique Chance (10)
4th – Integrate (6)
5th – Declan (12)
6th – Revell Yell (11)
The Information reads as follows:
“I the above named informant allege that horse number (5) or its driver placed 2nd by the Judge interfered with the chances horse number (11) placed 6th by the Judge – Onslow Hanover shifted out shortly after straightening for the run home locking wheels with REVELL YELL which resulted in the near side tyre being removed from the rim.”
Rule 869(8) provides as follows:
“The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.”
The connections of “Revell Yell” were represented at this hearing by Mr G. D. O’Reilly, the driver of the horse. Mr M. P. Jones, the driver of “Revell Yell” represented the interests of that horse.
Submissions for Decision:
Mr G. D. O’Reilly gave evidence that he led into the straight, with “Onslow Hanover” in the trail. When in the straight “Onslow Hanover” moved up on his inside, but then shifted out locking wheels and damaging the tyre which came off the rim. Mr O’Reilly said that because of this damage his chances were affected.
Video coverage was used by Stipendiary Steward Mr Ray to illustrate this incident. It was seen that “Revell Yell’s” chances were affected by the damaged tyre.
Mr Jones had no evidence to offer, and when asked indicated that he did not contest the protest.
Reasons for Decision:
After seeing the video coverage and hearing the evidence we were satisfied that there had been interference by “Onslow Hanover” to “Revell Yell”, and that this interference had affected the progress and chances of “Revell Yell”. We were satisfied that the protest should be upheld.
