Due to Dionysus being disqualified the placings now read:

1st  Roxanne
2nd Escape the Fate
3rd Millwood Roxy
4th Mia’s Dream
5th Flying Louie

The committee ordered that dividends and prize money be paid on the amended placings.

Facts:

Mr Muirhead alleged that Dionysus’ sulky wheel went inside the track marker line for more than 30m which in turn enabled it to get an advantage (over the final stages).

Judge' placings were:

1st Roxanne
2nd Escape the Fate
3rd Dionysus
4th Millwood Roxy
5th Mia’s Dream
6th Flying Louie

Submissions for Decision:

Mr Muirhead showed all available films and said that in the run over the final stages Dionysus improved its position up inside the leading horse (Roxanne) when there was insufficient room to do so and that the inside sulky wheel went over and inside some markers for more than 40m. He said that by improving where it did Dionysus gained an unfair advantage.

Mr Poutama said his drive was running in a little bit, that he tried to get him out, but he kept hanging in.

Mr Adlam for the connections said that Dionysus was full of running, had nowhere to go and that no other runner had made ground on Dionysus and in his opinion he did not gain an advantage. Mr Ferguson reiterated the comments of Mr Adlam.

Reasons for Decision:

The committee found that Dionysus did improve its position when there was insufficient room to do so and as a consequence went over and inside marker pegs for at least 40m. The committee was satisfied that by taking this course Dionysus did gain an unfair advantage and acting pursuant to Rule 869(7)(B) disqualified the horse.
