As Miss Wynne admitted the breach we find the charge proved.

Penalty:

We grant Miss Wynne’s request to seek a deferment to her suspension as per rule 1106(2).  Accordingly we impose a two day suspension on Miss Wynne commencing at the conclusion of racing on Thursday 24 April 2014, to the conclusion of racing on 1 May 2014. This effectively being two South Island meetings, Marlborough 27th April 2014 and Riverton 1st May 2014.

Facts:

At the conclusion of race 4 The Insurance Brokers Alliance and Locations Real Estate Handicap an information (A3854) was lodged by Stipendiary Steward Mr M Davidson under rule 638(l)(d) alleging that apprentice Jockey Miss S Wynne with approximately 200 metres to run Nolawood (S Wynne) shifted ground inwards when insufficiently clear of Wiseguy (B Pitman) causing Wiseguy to check.

The rule reads 638(l)(d): a rider shall not ride a horse in a manner which the Judicial Committee consider to be careless.

Miss Wynne acknowledged she understood the nature of the charge, the rule, and confirmed her admission of the breach.

Mr P Rudkin, Miss Wynne’s employer, assisted Miss Wynne at the hearing.

Stipendiary Steward Mr Davidson showed the committee several video clips of the alleged incident highlighting the inwards movement of Nolawood (S Wynne) when the horse in his opinion was insufficiently clear of Wiseguy (B Pitman).

Mr Davidson stated that there had been a little movement outwards from Romney (Miss T Direen) who was racing inside of Nolawood, but this had very minimal effect on Nolawood’s inward movement.

Miss Wynne stated that she had made an error of judgement and that she realised “too late” that she had moved inwards onto Wiseguy when not clear enough.

Stipendiary Steward Mr Davidson stated that Miss Wynne was a successful apprentice Jockey, having had 117 rides this season, with 32 winning rides.

Miss Wynne received a two day suspension at the Ashburton meeting on 14 May 2013.

Mr Davidson believed the breach was at the low end of the scale and that a two day suspension would be appropriate.

Miss Wynne stated she had some riding commitments at the Marlborough Meeting on Thursday 24 April 2014 and that she seeks a deferment to enable her to ride at this meeting.

Reasons for Penalty:

In considering penalty the committee took into consideration Miss Wynne’s previous breach in May 2013 at the Ashburton Meeting where she received a two day suspension. In taking the JCA Penalty guide starting point of 5 days we were able to give Miss Wynne a discount of 1 day for her admission of the breach, and a further days discount for the low level of the breach. We also gave Miss Wynne a further 1 day discount, as her previous breach was 11 months ago, and that she was a very busy successful apprentice rider.

The committee determined a two day suspension was an appropriate penalty.
