Charge:

Following the running of race 7 an information was filed by Mr. J Muirhead alleging a breach of rule 869 (4) in that Junior Horseman Z Butcher driving Garndor impeded the progress of La Novic De Milo driven by J Stormont during the run home.

The rule was read and confirmed as understood by those present.

Facts:

Mr. Muirhead explained to the committee that all present would have a good understanding of this incident after viewing the films from the previous protest. While continually driving his horse out in the home straight he has moved in onto Mr. J Stormont, keeping Mr. Stormont in cramped quarters and locking wheels and forcing him onto the pylons.

Mr. Butcher stated that he had misjudged the gap he thought he had left Mr. Stormont who had called out and as the films show he had pulled off as best he could and had ended up locking wheels.

Submissions for Penalty:

Mr. Muirhead presented a clear record by Mr. Z Butcher under this rule and as he had admitted the breach, identified a penalty in the J.C.A guidelines starting point of $300/$400.

Mr. Z Butcher asked the committee to consider that this was his first breach of this rule, that he was a Junior Horseman and that he did not go forward with the protest. He sought a penalty at the lower end.

Reasons for Penalty:

In reaching a decision the committee has taken into account the early admittance of the breach and Mr Butcher’s acceptance of responsibility in not contesting the protest. This is also his first offence under this rule. However, there was a relegation between 2nd and 3rd placings and the penalty range as submitted by both parties was assessed to be at the lower end of the guidelines.
