As Mr Laking has admitted the breach it found to be proved.

Penalty:

Mr Laking is suspended after racing on 14 April (riders having been declared up until this day) up to and including 28 April 2019.

 

Facts:

Mr Davidson alleged that Mr Laking (ROAD TO REDEMPTION) in race 9, the SEE YA AT WINGATUI 24TH MAY HANDICAP, allowed his mount to shift outwards when insufficiently clear of MADAM DE SOIR (C Barnes) which clipped a heel and blundered.

Mr Oatham, Chief Stipendiary Steward, demonstrated on the films that Mr Laking at the 600 metres was racing mid field with Ms Barnes a little further back and to his outside. He then shifted outwards off the heels of MORENA ROC (L Hemi) and into the line of Ms Barnes. He was not his length and another clear. Mr Oatham pointed out that Ms Barnes had come from behind Mr Laking quite quickly.

Mr Laking explained he had been following Ms Hemi and he saw Ms Jonker come up and he decided to go with her. He said he did have “a peep” before shifting and saw Ms Jonker but did not see Ms Barnes. He acknowledged he had come out too quick and too sharp. He had over-reacted when he saw Ms Jonker coming and should have waited another 3 or 4 more strides. He accepted he had taken Ms Barnes’ line and had caused interference.

Submissions for Penalty:

Mr Davidson produced the respondent’s record which evidenced 4 previous breaches of the careless riding rule. These were: 4 July, 22 September, 9 October 2018, and 2 February 2019. He said the respondent’s record was “not good”.

He said the Stewards believed that the breach was mid-range and Mr Laking had been caught out to some extent by the fact that Ms Barnes had improved very quickly.

Mr Laking said he accepted Mr Davidson’s assessment of the breach as mid-range.

Reasons for Penalty:

Mr Laking has shifted outwards after passing the 600 metres looking for a run, when not clear, and has come into Ms Barnes’ running line. She has clipped a heel and her horse has blundered. As Mr Laking said, he has come out too quickly and he only needed to wait for another 3 or 4 more strides and he would have had a run.

The Committee takes an 8-day starting point as in the Penalty Guide, and uplift this by 1 day for Mr Laking’s record. The Committee does not overlook the fact he is a fairly busy South Island rider, but he has had 3 breaches in the past 6 months. After a one-day discount for admission of the breach, the penalty is an 8-day suspension.
