As Mr Mudhoo had admitted this breach of the Rules it was found to be proved.
Penalty:
Mr Mudhoo’s Class A Jockeys licence is suspended from the conclusion of racing today 12 July 2019 up to and including 25 July 2019. Of note the meetings at Wellington and Ruakaka on 13 July were not included in the suspension period as riders were already declared for both meetings.
Facts:
Following the running of Race 10, the Skyline & JFK Homes Stayers Maiden 2100m, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Class A Rider, Mr K Mudhoo, in that he permitted his mount JILDI JILDI, to shift inwards when not sufficiently clear of PEGGY STEWART, which was checked near the 2000m.
Rule 638(1)(d) provides as follows:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Mudhoo had endorsed the Information that this breach of the Rules was admitted, which he confirmed at the hearing. Mr Mudhoo also agreed that he understood the charge and the Rule it was brought under.
Mr McLaughlin, with the assistance of Chief Stipendiary Steward Mr J Oatham, gave evidence and used video coverage to show that JILDI JILDI, ridden by Mr Mudhoo, had jumped from the 4-starting position with PEGGY STEWART, ridden by Mr BB Hong, jumping from the 3-barrier position. Mr Oatham stated, when showing the relevant side on, head on and back straight films, that shortly after the start Mr Mudhoo was on an inward movement to take up a position closer to the rail when he allowed his mount to shift in, when not clear of PEGGY STEWART, causing that horse to check. Mr Oatham said that Mr Mudhoo was barely a length ahead of Mr Hong. He added that Mr Mudhoo’s mount was tending to lay in and he did attempt to correct his mount, but this was not enough and too late to prevent the interference occurring.
Mr Mudhoo stated that the incident was clear on the films and he had moved inwards too quickly, causing the incident.
Submissions for Penalty:
Mr McLaughlin stated that Mudhoo’s record showed 2 breaches over the previous 12 months being 1 November 2018 at Gore where he received a 7 National Day suspension followed by a 7 National Day suspension at Otago on 2 February 2019. Mr McLaughlin stated that the breach was slightly above low range and taking all factors into consideration, submitted that a 6 National Day suspension be considered as penalty in this case.
Deferment was not an option for Mr Mudhoo as there were no relevant meetings over the next 7 days. He confirmed he sought any suspension to begin immediately.
Reasons for Penalty:
In determining penalty, the Committee took into consideration Mr Mudhoo’s admission of the breach and the level of carelessness, which we also assessed as just above low range. We also considered Mr Mudhoo’s penalty record which showed 2 breaches over the previous 12 months, his most recent on 2 February this year. Due to his most recent breach being 5 months prior, we were prepared to treat Mr Mudhoo’s record as a neutral factor. The JCA Penalty Guide provides a starting point of a 6-day suspension for a low-range breach and with our assessment that the breach was above low-range, we adopted a 7-day starting point for this breach. We determined there were no aggravating factors, therefore no uplift on penalty warranted. We were, however, able to afford Mr Mudhoo a discount of 1 day for his admission of the breach. We therefore determined that a 6 National-day suspension was an appropriate penalty in this case.
