As the charge was admitted it was deemed proved. 

Penalty:

Ms Morgan is suspended from the completion of today’s racing up to and including 19 June 2015. For the purposes of clarity means that she is suspended from riding at the Timaru Jockey Club meeting on the 12th June, the Oamaru Jockey Club meeting on 18 June 2015 and at Otaki on 19 June 2015. Again for the sake of clarity Ms Morgan may return to riding at Riccarton on the 20th June 2015 for the Amberley Jockey Club meeting.

Facts:

Following the running of Race 7, the RON WILLIAMSON OPEN HANDICAP 1200M an information was filed. Ms A Morgan (Apprentice Jockey), represented by Mr M Pitman Jnr, admitted a breach of Rule 636(1) (d) in that she “...failed to ride her mount Jazzman out fully to the finish.”

Rule 636(1) (d) states that:

(d) being the rider of a horse in a race must ride his or her horse out to the end of the race if there is reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared”.

In this case Mr J McLaughlin informed the committee Ms Morgan’s mount was beaten for fourth for which prize money of $750 was allocated. The official margin between fourth and fifth position was a neck.

Mr McLaughlin using the available films, pointed out to the committee that about 50m short of the line Ms Morgan, who was riding as she should, appeared to ease off and stop riding culminating in her standing in her irons short of the line. He believes that the actions Ms Morgan took by not riding her mount out cost the connections fourth place money.

Ms Morgan informed the committee that she felt her mount was at the end of its run. She freely admitted that she stopped riding her mount in order to save the horse over the concluding stages. She stated Jazzman was a natural front runner who had felt flat from the 1000m mark. Whilst Ms Morgan admitted that she had stopped riding she acknowledged to the committee that she was aware of the horse to her outside challenging for the position of fourth but thought that she had that particular horse covered.

Mr Pitman Jnr confirmed Ms Morgan’s interpretation of the incident and also pointed out that at or about the 50m mark there was pressure from the outside on Ms Morgan’s mount following which she stopped riding.

Submissions for Penalty:

Mr McLaughlin informed the committee that Ms Morgan’s record under this rule was good but for a similar incident when beaten for third at the same meeting 12 months ago. Mr McLaughlin felt that it was an error of judgment on her part and having regard to the new penalty guide warranted a starting point of two weeks suspension.

Ms Morgan submitted that that would be a harsh outcome given her commitments in the coming weeks and given the low level nature of her error.

The committee offered Ms Morgan the opportunity to consider a deferral in order for her to ride at Timaru in the next week which Ms Morgan declined.

Reasons for Penalty:

Ms Morgan was told by the Committee that in arriving at its decision to impose a suspension of, in effect, three days, for this breach it took into account her record under this Rule and her admittance of the breach. She is reminded that as a relatively experienced apprentice who rides in both the South Island and in the Central Districts that she has an obligation to ride her mounts out fully.
