Decision:

The committee was satisfied a clear breach of the rule had occurred and that Mr R Bishop has moved his horse Champagne Needed inwards when not sufficiently clear crowding and checking several horses.

Penalty:

Mr R Bishop was suspended for eight South Island race days commencing at the conclusion of racing on Friday 25th February 2011 (7 day rule applies) until the conclusion of racing on Friday 1st April 2011.

Mr R Bishop was also clearly reminded by the chairman of his professional obligations as a jockey on the race track and that he was indeed very fortunate that the outcome of the interference to the horses did not result in a far worse situation.

Charge:

At the conclusion of race 8 The ILT Ascot Park Hotel Southland Guineas an information was lodged by Stipendiary Steward Mr M Davidson alleging that Jockey Mr R Bishop permitted his mount Champagne Needed to shift inwards when not clear causing Au Natural (M Carston) The Glitzy One (S Muniandy) and Milo (D Walsh) to be severely crowded and checked.

The rule reads:
No rider shall ride carelessly.

Jockey Mr R Bishop admitted a breach of the rule. 

Facts:

Stipendiary Steward Mr J Mc Laughlin showed the Committee several video clips (Side on, Back on) of the alleged incident highlighting in his opinion the inward movement of Champagne Needed onto Au Natural with; The Glitzy One and Milo also being checked as a result of the movement.

Mr J Mc Laughlin also stated that in his opinion it was very fortunate that the horse The Glitzy One did not fall due to the severe tightening caused by Champagne Needed coming across when not clear.

Mr R Bishop after viewing the video clips stated that he had made an error of judgment in coming across the horses when not clear.

Submissions for Penalty:

Stipendiary Steward Mr M Davidson stated that he believed that the breach of the rule was at the high level of the scale of carelessly.

Mr Davidson suggested a range of penalty between 7 or 8 riding days would be appropriate. Mr Davidson also added that in addition to a suspension a monetary fine may also be considered by the committee.

Mr Davidson confirmed that Mr R Bishop was deemed as a South Island rider, not a National rider. This point was acknowledged by Mr Bishop.

Mr Davidson stated that Mr R Bishop had received a Two day suspension at the Canterbury Jockey Club Meeting on December 17th 2010.

Mr R Bishop stated that he had three or four rides normally on any one race day and that he had commitments at the up and coming meeting in Christchurch on Friday 25th February 2011.

Reasons for Penalty:

In fixing penalty the Committee was satisfied that the breach of the rule was at the high end of the scale and being a stakes listed race the consequences to the affected runners was severe.

Mr R Bishop was given credit for his early admittance of the breach and for his very good riding record over the past 12 months.
