Balancing the above matters with emphasis on the excellent driving record of Mr Lawson, a fine of $200 is imposed.

Junior Horseman S Lawson improved SIXPENCE outwards from the running line at about the 1900 metres forcing RICO GEAR (Mr P Ferguson) to race wider on the track, resulting in SIXPENCE breaking and checking FULLAVINO (Mr B Mangos).

Facts:

Mr Muirhead showed the video film of the incident. He said Mr Lawson moved SIXPENCE outwards in an attempt to force RICO GEAR to race wider on the track. He said this outward movement was a breach of the “push out” rule. He said SIXPENCE broke and came back on FULLAVINO which also broke. He said SIXPENCE should not have broken in the circumstances.

Mr Lawson and Mr Cooney accepted the interpretation of Mr Muirhead, in particular agreeing that SIXPENCE should not have broken.

Submissions for Penalty:

Mr Muirhead said Mr Lawson had no relevant breaches of the rules recorded against him, the offending was mid to lower range, the recommended starting point for penalty was a fine of $250. He submitted that a fine in the vicinity of $200 should be imposed.

Mr Lawson and Mr Cooney accepted the submissions of Mr Muirhead.

In fixing penalty the committee takes into account the admission of the breach, the clear record of Mr Lawson, the submissions of Mr Muirhead and the acceptance of them by Mr Lawson, the recommended starting point, the Junior Horseman status of Mr Lawson, other penalties imposed for a breach of this rule and accepts the offending is mid to lower range.
