As Mr Sweeney had admitted the breach we find the charge proven.

Penalty:

Balancing the above matters but with emphasis on the good riding record of Mr Sweeney, his riders licence is suspended for 4 days commencing at the end of racing on 21st November and concluding at the end of racing on 1st December 2010.

Charge:

Permitted his mount ROYDON to shift inwards near the 1000metres when not sufficiently clear of GIMMEABREAK which was checked.

Facts:

Stipendiary Steward Mr J Oatham showed and interpreted the video films of the incident. He said ROYDON was racing 4 wide. Mr Sweeney eased the horse and moved it inwards when insufficiently clear of GIMMEABREAK, resulting in that horse having to be sharply restrained for several strides.

Submissions for Decision:

Mr Sweeney accepted the interpretation of Mr Oatham. He said it was his first day of riding since being injured on the 3rd May 2010 and his judgment “was a bit rusty”.

Submissions for Penalty:

Mr Coles said Mr Sweeney had a very good riding record prior to being injured. He said the offending was mid range and submitted that a suspension at the lower end of the scale was appropriate.
 
Mr Sweeney accepted the submissions of Mr Coles. He asked that any suspension commence after he had completed a riding engagement he had on the 21st November 2010.

In fixing penalty the committee takes into account the admission of the breach, the submissions of Mr Coles and the acceptance of them by Mr Sweeney, the good riding record of Mr Sweeney, the minimum penalty of 4 days suspension for careless riding and views the offending as mid range on the scale of seriousness
