Facts:

Information No. 246 was filed by Chief Stipendiary Steward, Mr C J George, against Licensed Jockey, Miss K Williams, alleging a breach of Rule 340 in that she “misconducted herself by slamming the door on leaving the Stewards’ room”.
 
Miss Williams had signed the Statement by the Defendant on the information form indicating, firstly, the she admitted the breach and, secondly, that she did not wish to be present at the hearing of the information.
 
Rule 340 provides as follows:
A Licensed Person, Owner, lessee, Racing Manager, Official or other person bound by these Rules must not misconduct himself in any manner relating to the conduct of Races or racing.

 

Submissions for Decision:

Mr George stated that, following Race 7, the Stewards inquired into an incident at the barrier. A jockey had complained to the Stewards about certain comments made by another jockey prior to the field jumping. The Stewards spoke to the jockeys concerned, M Misbah and Miss Williams.
 
Mr George said that it was clear to him that Miss Williams did not appreciate being questioned. The conversation got “a little bit heated”. Miss Williams was then asked to leave the room and, on exiting, it was very evident that she chose to slam the door, Mr George said. Mr George submitted that her conduct was “completely inappropriate”.
 
Miss Williams was summoned back into the room and she showed no remorse for her actions, Mr George said.

 

Submissions for Penalty:

Mr George said that the Stewards have been concerned on a couple of recent occasions about Miss Williams’ conduct. He submitted that jockeys need to show respect to Stewards and, on this occasion, Miss Williams’ acted in a totally disrespectful manner. He submitted that a fine of between $150 and $200 was appropriate.

 

Reasons for Penalty:

The Committee noted Mr George’s submission as to the amount of fine that should be imposed. The Committee also considered that the degree of seriousness of Miss Williams’ conduct was in the low range. However, Miss Williams’ actions were not acceptable and there needs to be consequences for such behaviour. Miss Williams and, indeed, all licenceholders need to be aware that disrespect of Stewards will not be condoned. In this particular case which, as stated, is not in the serious category, a fine at the lower end of the range submitted by Mr George is sufficient in the Committee’s view.
