As Mr Bradley admitted the breach we found the charge proved.

Penalty:

Accordingly, Mr Bradley is suspended from the close of racing today, May 18th 2019 up to and including racing on Wednesday, June 12th 2019.

Facts:

Following the running of Race 8 (AB Equipment/PTS Logistics 1600), an Information was lodged by Mr N Goodwin alleging a breach of Rule 636 (1) (d) in that D Bradley relaxed his ride over the final stages when in at least equal 2nd placing.

The rule reads:

636 (1) A person:

(d) being the Rider of a horse in a Race must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared;

Mr Goodwin used syncronised head and side-on videos of the final stage of the race to explain the incident. Mr Bradley was riding SPONDULIX and was in second place when approximately three strides short of the finish line, he relaxed his ride. WHATSUP, who was finishing quickly down the outside of SPONDULIX, got up to beat him by a half head margin. Mr Goodwin said before easing, Mr Bradley had been riding with the whip.

The Chairman asked Mr Goodwin whether, in his opinion, Mr Bradley’s actions cost his mount second placing. Mr Goodwin said he could not answer that question, but by failing to ride out, Mr Bradley did not give his mount that opportunity.

Mr Bradley said on turning for home he was forced to an inside run. He was trying to run down the eventual runner and believed he had ridden his horse right through to the line. Mr Bradley said he wasn’t sure who had run second and did not think he had relaxed his ride. It wasn’t until he saw the video replays in the Stewards’ room that he conceded he may have relaxed but said his actions did not affect the result of the race. Mr Bradley said horses don’t lose momentum in 2-3 strides.

Mr Bradley also made mention of the lack of clear markings on the fence and the large sponsor’s truck parked behind the winning post making it difficult to accurately assess the finish line.

Submissions for Penalty:

For the Stewards Mr Goodwin said Mr Bradley had a clear record under the rule and submitted that a suspension in line with the Judicial Committee Penalty Guidelines was appropriate.

Mr Bradley was invited to make submissions on penalty but declined. He advised that any suspension could begin straight away.

Reasons for Penalty:

After viewing all films at normal speed and having regard to the half -head margin it was the opinion of the Committee that had Mr Bradley not eased up, it was very likely that SPONDULIX would have run second instead of third. This had serious consequences for the connections of the horse and the betting public. It is the responsibility of every rider to ensure they ride out fully to the finish and, unfortunately Mr Bradley neglected to do so on this occasion.

Although Mr Bradley put forward some excuses for what happened, we are of the mind that it was simply an error of judgement.

The Penalty Guide for Judicial Committees has a sliding scale of starting points relating to the potential placing deemed to have been lost. In the case of Rule 636(1)(d) the starting point for missing second placing is a 4-week suspension, and we adopted this as our starting point.

For Mr Bradley’s record and admission of the breach we afforded him three riding days discount.
