Accordingly after taking all the above into account we impose a fine of $275.
Facts:
Prior to Race 7 the informant Mr B Jones filed an information alleging that Mr M McNab rider of DEZIGNATOR in that race was unable to make the weight being 1kg over.
Rule 330(3) (c) reads: A Rider shall not fail to ride a horse at a weight at which it is handicapped to carry.
Mr Jones informed the committee that Mr McNab approached the stewards early in the day informing them he would be unable to make the carded weight for his mount DEZINGATOR in race 7 and would be 1kg over.
Mr McNab said it was his first day back after being out with an injury but was confident of making the 55kgs when he took the mount.
Submissions for Penalty:
Mr Jones said Mr McNab had incurred 2 fines in the last 120 days for being overweight, one of $200 and one of $225. He submitted a fine of a similar amount would be appropriate.
Mr McNab had nothing to say regarding penalty.
Reasons for Penalty:
The committee considered the evidence and submissions and before imposing a penalty reminded Mr McNab of his obligations before accepting engagements.
We find that an increase in the quantum of the previous fines should be imposed.
