Facts:
Following the running of Race # 9 the CENTREPOINT-SOUTH CITY LIQUORLAND MOBILE PACE Stipendiary Steward Mr S Renault lodged a protest against the third placed POCKET SALLI (J W Cox) alleging that J Cox shifted inwards and made contact with CHEROKEE CHARLIE (S Walkinshaw) resulting in CHEROKEE CHARLIE breaking and losing its chance.

Mr Davidson showed the video pointing out the positions of POCKET SALLI and CHEROKEE CHARLIE at the start and also racing into the first bend where the interference took place.
Mr Renault stated that Mr Cox (POCKET SALLI) was wider on the track approaching the first bend when he shifted down before coming into contact with CHEROKEE CHARLIE. He stated the inside sulky wheel struck the hind leg of CHEROKEE CHARLIE before both sulkies locked wheels briefly. This interference resulted in CHEROKEE CHARLIE becoming unbalanced and eventually breaking on entering the bend and losing its chance.
Mr Walkinshaw stated he drew two on the second row and was attempting to hold his position in the one-out line when the interference took place. He said his horse’s leg had been struck, and then both sulkies had locked wheels. This had caused his horse to break. He did not believe Mr Cox had an advantage on him to shift him down.
Mr Cox stated he had shifted down and had an advantage on Mr Walkinshaw’s horse. He said Mr Walkinshaw had taken a hold of his horse which caused it to pace roughly and break. He felt he was entitled to shift CHEROKEE CHARLIE down and while the shafts of both horses had made contact he disagreed his sulky wheel had made contact with the hind leg of CHEROKEE CHARLIE. He said his horse had hung in slightly on the bend but did not believe his actions or his horse was at fault.

The Committee was of the view that interference did take place between POCKET SALLI and CHEROKEE CHARLIE which resulted in CHEROKEE CHARLIE breaking and losing its chance.
