Penalty:

Miss Taylor you are suspended from racing riding from after the completion of racing on Saturday the 25th of February until the completion of racing on Saturday the 3rd of March (4 North Island days).

Failing to ride out.

Facts:

Miss A Taylor admitted a breach of rule 636 (1) (c) in that as the rider of MR KEENINSKY she failed to ride her mount out fully to the finish. Miss Taylor's mount finished 5th and the margin between 4th and 5th was half a head.

Miss Taylor along with her representative, Mr G Barlow confirmed she understood the rule and that she admitted the breach.

Mr Neal showed the available films and informed the committee that Miss Taylor's mount was clearly running 4th until just short of the winning post.

She had put the whip away about 80 metres short of the line and was riding hands and heels. After pushing forward with her hands, about 50 metres out she stopped riding and the horse down on her inside APHELION got up to run fourth.

Miss Taylor had no comment on any of the available films of the incident and reiterated again that she did stop riding.

Mr Barlow agreed that she did sit up about 3 strides short of the post. He believed that as a young apprentice who doesn’t get many rides the lapse of judgement could possibly be put down to not being fit.

Submissions for Penalty:

Mr Neal submitted that in the past 12 months Miss Taylor had not been charged under this rule. She is now based in the Waikato district and only rides in the North Island.

He asked the committee to take into account when setting the penalty which he believed should be one of suspension that the actions of Miss Taylor cost the first four investors a dividend. He cited two cases of apprentices who were charged under this rule (both losing 4th place) and periods of suspension ranging between 2 – 3 days were imposed.

Mr Neal submitted again that he believed had Miss Taylor continued pushing her mount to the line she would have run 4th.

Mr Barlow on Miss Taylor's behalf informed the committee that she had a confirmed ride this coming Saturday and after the deferment rule was explained Miss Taylor asked for any suspension imposed to begin after racing this coming Saturday. She confirmed that she was a North Island rider only.

Reasons for Penalty:

Miss Taylor in coming to our decision to impose a period of suspension for this breach we are mindful that as an apprentice you do not get many rides and that you ride in the North Island only. This committee considered the penalties imposed for similar breaches.

However in this particular incident when just short of the line you dropped your hands after putting the whip away. We agree with Mr Barlow that this happened about 3 – 4 strides short of the post and the actions you choose to take cost the first four investors an opportunity to be rewarded . There was also a difference of $125 between the stake money paid out for 4th and 5th placing.

Using the recommendations in the Penalty Guide as a starting base we have given you a discount for your admittance and your record. Even although only first four investors were affected we are of the opinion that the penalty imposed must reflect our concerns for the betting public.

Rule 636 (1) (c) is quite clear ‘being a rider of a horse in a race must ride his or her horse out to the end of the race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared’.
