Facts:
Following the running of the SIMS PACIFIC METALS NORTHERN BREEDERS STAKES an Information was lodged by Senior Stipendiary Steward Mr N Ydgren against Licenced Driver Mrs M Teaz alleging that Mrs Teaz as the Driver of MISS BLISSFUL drove carelessly at the 380 metres mark when striking the wheel of OUR PETITE LADY (Driver J Stormont) causing her horse to break.
Rule 869(3)(b) provides : No horseman in any race shall drive carelessly.
Mrs Teaz was present at the Hearing and advised the Committee that she admitted the breach.
Mr Ydgren demonstrated the incident by use of the race films. He identified Mrs Teaz's horse racing 4 back on the fence behind ANNA KATE and at about the 380 metres mark that horse was under pressure so Mrs Teaz shifted out to avoid being held up but the horse in front of her was under pressure and she then shifted back in and in doing so struck the inside wheel of OUR PETITE LADY and this caused her horse to break.
Mrs Teaz advised the Committee that she could not add anything further. She acknowledged that she moved out for a run and then changed her mind.
Submissions for Penalty:
Mr Ydgren said that Mrs Teaz has had 10 drives this season and 20 last season and she has been driving for a number of years. He said she had an excellent record.
Mr Ydgren referred to the JCA Penalty Guide which provides for starting point penalties of suspension of Licence for 6 drives or a $300.00 fine. He said that in this instance there should be an uplift of $50.00 for the consequences for the connections of MISS BLISSFUL.
He then submitted that Mrs Teaz should be given credit for her admission of the breach and her excellent record. He submitted that a fine of $250.00 was appropriate.
Mrs Teaz said she would prefer a fine and as far as she is concerned "less is best".
Reasons for Penalty:
The Committee viewed the race films and assessed the evidence. It was unfortunate for Mrs Teaz that at the appropriate time her horse was travelling better than those in front of her and in trying to get a run she made an error of judgement. She was trying to do the correct thing for her horse.
She has admitted the breach but this was inevitable in light of the film evidence but we do however give her credit for her admission and her excellent record.
We have taken into account Mr Ydgren's submissions and we have also reviewed the JCA Penalty Schedules that we have the benefit of. We have taken into account the starting point penalties in our JCA Penalty Guidelines.
Taking all matters into account we believe that a fine of $250.00 is appropriate.
