As Ms Collett admitted the breach we found the charge proved.
Penalty:
We accepted Ms Collett’s assertion that she was intending to ride her father’s horse at the Oamaru meeting therefore we included this day in the penalty. Ms Collett is suspended from the close of racing on Saturday July 28th up to, and including, racing on Thursday August 2nd.
Charge:
Following the running of Race 1 an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1) (d) in that S Collett permitted her mount NASRINA to shift inward near the 900metres when not sufficiently clear of RAIVAC (D Walker) which was checked.
Facts:
Using the head-on view Mr Goodwin highlighted the relative positions of the horses and riders involved. Mr Walker was near the fence with Ms Collett out wider but seeking to gain a run closer to the rail. She hunted her horse forward and crossed in front of Mr Walker when not clear causing him to take remedial action.
Ms Collett had believed she was clear of Mr Walker when she crossed him. She explained how she had used her horse up trying to get a rails run and once she got to the front she steadied her mount but it eased up far more quickly than she was expecting.
Submissions for Penalty:
Mr Oatham said Ms Collett had no previous breaches of the careless riding rule in the last 12 months. He said she had been prompt in her admission of the breach and described the interference as at the lower end warranting a suspension towards the bottom end of the scale.
Ms Collett had no further submissions on penalty but advised the committee of riding commitments on Saturday at Taumaranui. She also said that while she does not ride often in the South Island she had intended going to Oamaru on Monday July 30th to ride a horse called GOLDEN GLOBE. This horse is owned by her father and used to be trained by him but was having its first start down south for Mr Pitman.
Reasons for Penalty:
The Judicial Committee adopted as a starting point a period of suspension of five days. In this case we could find no aggravating factors however there were several factors that we believed warranted a reduction from our starting point. Ms Collett is a busy rider and has an excellent riding record. She admitted the breach and the films showed she was not quite the required distance clear as she crossed in front of Mr Walker. He had to steady his mount as a result but this was exacerbated by the fact NASRINA eased up far more quickly than Ms Collett expected. Her level of carelessness was, in the opinion of the committee, at the lower end. Taking into account all of the submissions we have reduced the penalty by two days and accordingly impose a three day suspension.
