Ms Macnab is suspended for 4 national riding days commencing at the conclusion of racing on 5 June 2021, until the end of racing on 10 June 2021. In addition she is fined $500.
Facts:
Following the running of Race 5, the FIVE WISE MEN CUP, Senior Stipendiary Steward, Mr N Goodwin presented an Information alleging that Ms Macnab committed a breach of Rule 638(1)(d) in that she rode her mount PLEASURE carelessly.
The Information alleged that Ms Macnab permitted her mount PLEASURE to shift outwards when not sufficiently clear of HOOTER which was hampered near the 400 metres point.
Ms Macnab admitted the charge.
Chief Stipendiary Steward, Mr J Oatham, demonstrated from the Race films the events resulting in the breach of the Rule. Approaching the 400 metres point Ms Macnab allowed her mount PLEASURE to commence, and continue, an outward movement when not the required distance clear of HOOTER, ridden by Mr D Bradley, which started to improve on the outside. The movement dictated the line of that horse forcing it outwards for a significant distance. Eventually Mr Bradley had to elect to angle back to the inside of Ms Macnab to rally very strongly to finish in 3rd place. Ms Macnab’s mount finished 5th.

Mr Goodwin submitted that the careless riding breach was “mid-range”. He advised that Ms Macnab has only one previous breach of the Rule, in October 2021, with no offences ever before that. He said her good record was a distinct mitigating factor.
Ms Macnab advised she had committed riding engagements over the next 7 days so that any period of suspension could start thereafter.

We take as a starting point, a suspension of 5 days and a fine of $500 as recommended in the Penalty Guide. The careless riding resulted in Mr Bradley’s mount being inconvenienced to the extent that it was probably deprived of finishing at least 2nd. We allow a discount of 1 day for Ms Macnab’s commendable record.
