After taking all the above factors into account we suspend Mr Innes from riding in races which is to start after racing on 9 October and conclude after racing on 15 October 2011(4 days). This deferred penalty comes pursuant to rule 1106 (2a).

Facts:
Following race 2 the informant Mr A Coles alleged that Mr L Innes permitted his mount ZONZA to shift inwards crowding SOCIETY RULER (A Collett) passing the 350 metres. He said this inward movement continued causing SOCIETY RULER to lose its rightful line of running near the 250 metres.
Submissions for Decision:
Mr Oatham demonstrated the video films which showed ZONZA racing in a 4 wide position approaching the 350 metres. Mr Oatham said ZONZA then started to drift in but conceded that Mr Innes did have the horse's head turned to the side. He said SOCIETY RULER was on the inside of ZONZA and because of the inward movement from Mr Innes who was only a bare length clear, Miss Collett had to take hold of her mount. Mr Oatham explained Miss Collett crossed over the heels of ZONZA and lost ground as a consequence.
Mr Innes said his mount ZONZA was only having its second start and was racing greenly intending to hang. He further stated that SOCIETY RULER was not going well enough to hold its position and believed that 9 times out of 10 he would have only received a warning.

Mr Coles submitted this offence was in the low to mid range and a suspension of 4 to 5 days would be appropriate.
Mr Innes said he had commitments until after racing on 8 October.

The committee considered all evidence and submissions. Mitigating factors are Mr Innes' good record and his admission of the breach. In this case the committee finds Mr Innes' carelessness to be at the low end of the scale. However Miss Collett was inconvenienced through the inward movement of Mr Innes who was only a bare length clear.
