As Mr Service had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).
Penalty:
Accordingly Mr Service’s license to drive in races was suspended from the conclusion of racing 16 May 2015 up to and including 16 July 2015. This suspension encompasses the meetings at Dunedin on 21 May, Winton on 24 May, Dunedin on 29 May, 4 June, 11 June, 18 June, 26 June, 2 July and 16 July 2015.
Facts:
Following the running of Race 3, the Level One Restaurant & Bar Trot, an information was filed by Stipendiary Steward Mr N Ydgren against Graduation Horseman Mr F Service alleging a breach of Rule 869(3)(3)in that he miscounted the rounds when driving SUN SHINE WHIZ.
Mr Service had indicated on the Information that this breach of the Rules was admitted. Mr Service confirmed this at the hearing and he also confirmed he understood the Rule he was being charged with.
Rule 869(3)(g) reads as follows:
(3) No horseman in any race shall drive:-
(g) in any manner capable of diminishing the chances of his horse winning.
Mr Ydgren, gave evidence and used video coverage to show that SUN SHINE WHIZ, driven by Mr Service, was in last position in a 3 wide position near the 1300m. He said Mr Service then urged SUN SHINE WHIZ forward and was in a 5 wide position into the home turn where he continued to place the gelding under pressure consistent with the manner in which a driver would normally urge his horse over the final stages of a race. Mr Service continued on urging SUN SHINE WHIZ until passing the winning post and then immediately desisted in his urgings with the horse being eased down out of the race. Meanwhile the remainder of the field continued on with the final lap with Mr Service not completing the event.
Mr Service was very remorseful about his drive of SUN SHINE WHIZ and stated that “It was a terrible display of driving.”
Submissions for Penalty:
Mr Ydgren informed the Committee that Mr Service had been very frank in his admission of the breach and that he had a clear record in regard to this Rule. He said that Mr Service had had 180 lifetime drives with 28 drives so far this season. Mr Ydgren stated that the JCA Guidelines recommended a starting point of a 15 drive suspension or a $750 fine for a breach of this Rule. Taking all factors into consideration Mr Ydgren submitted that a suspension of 10 days be considered as the penalty in this case as Mr Service had informed the Stewards that he was not in a position to pay a fine.
Mr Service confirmed to the Committee that he was not in a position to pay a fine and submitted that a suspension be considered. Mr Service also informed the Committee that on average he drove once a day at most Southland meetings as well as meetings at Dunedin.
Reasons for Penalty:
In determining penalty, the Committee took into account Mr Service’s frank admission of the breach and his clear record. After taking the starting point recommended by JCA Penalty Guide of a 15 drive suspension for a breach of this Rule we were able to give Mr Service a discount of 3 drives for his frank admission of the breach and a further discount of 2 drives for his good record. We therefore determined that an appropriate penalty in this case was a suspension of 10 drives which the Committee determined was a 10 day suspension in for Mr Service.
