Mr Tidmarsh, Stipendiary Steward, alleged that in race 9, the PGG WRIGHTSON SALE OF THE STARS MOBILE PACE, Mr Swain (JAYEDGAR) used his whip 12 times in the final 400 metres.
The Use of the Whip Regulations made pursuant to r 869(2) and effective 30 November 2017 provides:
No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr Tidmarsh demonstrated on the videos that the respondent, who was racing outside the leader entering the home straight, used his whip 12 times.
Mr Swain has signed the information stating he admits the breach and does not wish to be present.
