Facts:
Following the running of Race 1, an Information was filed by Chief Stipendiary Steward, Mr N Ydgren, against Open Driver, Mr R Holmes, alleging that “Mr Holmes (SUGARINSPICE) drove carelessly near the 700m when allowing his horse to contact the sulky wheel of GLOBAL FLIGHT which punctured”.
Mr Holmes confirmed he was conversant with the Rule and that he admitted the breach.
Rule 869 provides as follows:
(2) No horseman in any race shall drive: -
(b) carelessly
Mr Ydgren used the race films with the assistance of Mr Williams to identify Mr Holmes (SUGARINSPICE) racing mid field in the running line at approximately 800 metres from the finish. He pointed to Mr Holmes’ horse near fore hoof touch GLOBAL FLIGHTS offside sulky wheel which punctured.
Mr Holmes had nothing to add to Mr Ydgren’s evidence.
Submissions for Penalty:
Mr Ydgren stated Mr Holmes breached this Rule on the 10 March 2021 at Oamaru which was 31 drives ago and was fined $300. He said the Penalty Guide has a 3-day suspension as a starting point for a second breach of the careless driving Rule within a six-month period.
Mr Holmes made no submissions on penalty but requested a deferment of suspension until after the 9 April 2021.

The Committee carefully considered all the evidence and submissions presented.
The Committee considered this case a clear breach of the Rule. GLOBAL FLIGHT (A Lethaby) has carried a punctured tyre for 700 metres impacting its chances.
The mitigating factor is Mr Holmes’ admission of the breach.
The Committee in considering the above factors find a 3-day suspension as an appropriate penalty in this case.
Mr Holmes is granted deferment pursuant to Rule 1304(1).
