Pursuant to Rule 648 (3) the Committee disqualified YOUKNOWHATIMEAN from the race and ordered dividends be paid in accordance with this decision.

Facts:

This Request for a Ruling was filed pursuant to Rule 648(3) and arises following the running of Race 4, The GRASSROOTS PETITION MAIDEN 1200 metres. The Informant, Stipendiary Steward, Mr A Coles, alleged that the rider of YOUKNOWWHATIMEAN (A Calder) weighed in 1kg underweight.

Rule 648(3) provides that:

If, on being weighed in, a Rider cannot draw the proper weight (meaning thereby the weight allotted by the Handicapper for his horse to carry and adjusted only by any re-handicap, by having been declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5 kg and if the allowance is not sufficient to enable the proper weight to be drawn then subject to sub-Rule (4) of this Rule then in addition to any other penalty which may be imposed the horse shall be disqualified for the Race.

A Rider must not weigh-in at a weight that exceeds or is less than the proper weight as is defined in and with the allowance permitted by Rule 648(3).

Submissions for Decision:

Stipendiary Steward, Mr Coles advised the Committee that he was present at the scales when Mr Calder weighed in after the running of race 4. He said Clerk of the Scales, Mr R Sanders identified that Mr Calder weighed in at 1 kg under his allocated handicapped weight of 60.5 kg. The actual weight being 61.5 kg which accounts for the riders 1 kg protective vest allowance.

Mr Sanders confirmed the discrepancy to the Committee. He added that he followed his usual routine for recording weights of riders weighing out prior to the race and for weighing in after the race was run. He said there was a clear 1 kg difference when Mr Calder weighed in.

Mr Williamson said that YOUKNOWHATIMEAN finished out of a dividend or stake bearing placing (7th of 8 starters) and due to its rider weighing-in underweight its disqualification from the race is sought.

The weight difference was not disputed or contested by the rider Mr A Calder or Ms Waddell the trainer of YOUKNOWHATIMEAN. Mr Calder was not present at the hearing, and Ms Waddell attended briefly.

The reason for Mr Calder weighing in under weight could not be established and is the subject of a separate charge pursuant to Rule 649(3).

Reasons for Decision:

After considering the submissions the Committee was satisfied that Mr Calder weighed-in at 1 kg under his weigh-out weight, and is therefore in breach of the Rule.
