As Mr Lammas admitted the breach the Committee found the charge established.

Penalty:

Accordingly, Mr Lammas’ licence to ride in races is suspended for a period of 5 national days commencing after racing on 19th October 2019 and concluding after racing on 28th October 2018. The Committee did not include racing on the 20th October as the declaration of riders for that meeting were closed.

Facts:

This charge arises from the running of race 6, the West Brook Wines 1400. Stipendiary Steward Mr A Coles filed an Information pursuant to Rule 638 (1)(d) alleging the rider of GRAVITELLE, Mr C Lammas, permitted his mount to shift out near the 350 metres when insufficiently clear of SURF’N’TURF which was checked.

At the commencement of the hearing Mr Lammas acknowledged he understood the rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Using all available video footage Senior Stipendiary Steward Mr Williamson demonstrated the incident that gave rise to this charge and identified all horses and riders concerned. He told the Committee that nearing the 350 metre mark Mr Lammas allowed his mount GRAVITELLE, to shift out when approximately one length clear of SURF ’N ’TURF.  As a result that runner suffered a check and lost ground. He added that on this occasion Mr Lammas simply made an error of judgement.

In response Mr Lammas stated that his mount was green due to it having its first start in a race. He said that he accepted he rolled out and he did not realise SURF ‘N’ TURF was racing so close behind him. He added his mount “ducked out when he drew his whip”. 

Submissions for Penalty:

Mr Coles produced Mr Lammas’ riding record which indicated 2 previous breaches under the careless riding rule in the last 12 months. The most recent having occured in a Group 1 race at the Hastings meeting on 21 September 2019. This resulted in a 9 day suspension.

Mr Coles said Stewards assessed the level of carelessness at the low end. He said a mitigating factor was that Mr Lammas’ mount was having its first start and the outward movement was quick.

Mr Lammas advised he had no confirmed engagements during the next 7 day period and any proposed suspension could commence immediately. He submitted that the Committee should take into account that any penalty would inevitably cost him the chance to ride at pending Feature meetings where he had two good tentative riding opportunities that he would miss as a consequence. 

Reasons for Penalty:

After considering the submissions and after reviewing the race films the Committee determined the level of carelessness to be low range. On that basis we adopted a 6 day starting point. This is in conformity with the Penalty Guide for Judicial Committees which recommends a 6 national day starting point for low range carelessness.

There were no particular aggravating factors.

The mitigating factors we considered included Mr Lammas’ admission of the breach and his good riding record under this rule. For those combined factors we afforded Mr Lammas a 1 day reduction.

After taking into account all the above factors the Committee considered  a 5 day suspension an appropriate penalty.
