Winton HRC 11 February 2011 – R 9 (instigating a protest)
ID: JCA17832
Decision:
After hearing this evidence, Mr Allison sought leave from this committee to withdraw the information. We granted leave. The information was thus withdrawn. Final placings are as the horses crossed the line.
Facts:
At the conclusion of Race 9, an information instigating a protest by horse numbers 8 and 9 against horse number 7 was lodged by Mr Allison under rule 869(8)(b) alleging that with approx 800 metres to run SHARD ARK (No 7) (A M Armour) broke, checking GOODTOGO DENARIO (No 8) (B G Barclay) and FORREST BOBO (No 9) (A R Beck).
Submissions for Decision:
Mr Allison showed this committee a video clip of the horses racing at approximately the 800 metres mark. He pointed out that SHARD ARK (A Armour) broke and checked both GOODTOGO DENARIO and FORREST BOBO driven by B Barclay and A Beck respectively, which were racing behind SHARD ARK and towards the rear of the field.
Reasons for Decision:
In giving evidence, both drivers, Mr Beck and Mr Barclay, stated that whilst they had each lost approximately 2-3 lengths in the incident, they were adamant that this did not affect their chances of finishing in a stakes-bearing position.
