Facts:
Following the running of Race 9, the CHRISTIAN CULLEN MARES SPEED FINAL MOBILE PACE an information was filed by Stipendiary Steward, Mr N McIntyre, alleging Junior Horsewoman Miss M Neilson breached Rule 869 (2) (a) in that Miss Neilson used her whip in a manner which Stewards deem to be excessive during the run home...
Miss Neilson was present at the hearing and admitted the breach. Mr Butt was present to assist Miss Neilson.
Rule 869 (2) (a) provides:
No horseman shall during any race
Use his whip in an unnecessary, excessive or improper manner.
Mr Ydgren showed, with the use of the video, that Miss Neilson was leading in the home straight. She continued to drive her horse out to the finish but in doing so used the whip approximately 25 times. The Stewards deemed that to be excessive use of the whip.
Mr Butt stated that the video evidence was clear Miss Neilson’s use of the whip had been excessive.

Mr Ydgren stated Miss Neilson had admitted the breach at the earliest opportunity. Her record was excellent and she had not been charged with a similar offence. She had had approximately nine drives this season. The breach was at the lower end of the scale and he sought a fine of $200.
Mr Butt said Miss Neilson had driven in Australia for three seasons under Australian Rules. She had not been in New Zealand long and was still adjusting to the whip rule.
