Following the running of Race 10 (Visique Naylor Palmer Optometrists Handicap Trot 2500m) Information A2329 was filed with the Judicial Committee. The Information stated: "You failed to take all reasonable and permissible measures available to you between the 200m and the 50m to ensure that LATENT was given full opportunity to win the race."

Rule 868(2) was read and confirmed as understood by Mr Phelan, who also confirmed that he did not admit the breach.
