Facts:
Following the running of Race 1, WOODLEY’S TRANSPORT/TOM WALDRON BAYLEYS CANTERBURY SPEC MAIDEN SW, an information was filed by Stipendiary Steward Mr McLaughlin, against Licensed Jockey Mr L Callaway, alleging a breach of Rule 638 (1) (d) in that Mr Callaway, as the rider of “Mr Whiz” in the race, “…permitted his mount to shift inwards passing the 1300m mark and in doing so caused Waitin Awhile (T Moseley) and Keynote (A Comignaghi) to be checked and lose momentum.”
Mr Callaway was present at the hearing and indicated that he admitted the breach.
Rule 638 provides as follows:
(1) A rider shall not ride a horse in a manner which the Judicial Committee considers to be: (d) careless.
Submissions for Decision:
Stipendiary Steward, Mr McLaughlin, with the assistance of the head and side-on Race Videos, illustrated how Mr Callaway shifted inwards approaching the turn at the 1300m mark, causing Mr Moseley (Waitin Awhile) to take a hold of his mount and shift inwards hampering Miss Comignaghi (Keynote) on his inner. This caused both horses to be checked, losing their momentum and several lengths. He said at no time was Mr Callaway a full length clear of Mr Moseley.
Mr Callaway said Mr Mosely’s horse (Waitin Awhile) had overreacted and shifted inwards onto Keynote. He also said that Keynote had been forced to move outwards when approaching the bend and had contributed to the incident. However, he admitted he wasn’t a full length clear of Mr Moseley’s mount when he shifted inwards.
Submissions for Penalty:
Mr McLaughlin told the committee that Mr Callaway rode in both the South Island and Central Districts on a regular basis. He had not appeared before a committee on a similar charge since mid January 2012. He had a very good record and had fully co-operated with the Stewards. He sought a suspension of three days minimum which would include meetings in the Central Districts area.
Mr Callaway said he had admitted the charge. He had confirmed rides at Waikouaiti on the 1st January. He did not seek a deferment of any suspension. He said he was a regular rider at South Island meetings and usually had a full book of rides.
Reasons for Penalty:
The Committee determined a starting point of 5 days suspension as appropriate.
We took into account Mr McLaughlin’s submissions regarding Mr Callaway’s good record, his early admission and co-operation. We also took into account Mr Callaway’s submissions regarding his good record. The committee believed the interference was at the low/mid range.
Accordingly we considered a suspension of 3 racing days as an appropriate penalty.
