The charge is accordingly dismissed.

Charge:

Following race 3 an information was filed pursuant to Rule 606. The informant Mr Williamson alleged that Mr Waddell left the jockey’s room without gaining permission from the Stipendiary Stewards.

Facts:

Mr Williamson told the committee that the jockeys had asked his permission to open the back door of their room due to the warm conditions. He granted the jockeys request, however he observed Mr Waddell in the car park later in the day.

Submissions for Decision:

Mr Waddell said the charge lodged by Mr Williamson was stupid and a joke firmly believing he was being pedantic. He told the committee he went to ask permission from the Stewards to go to his car but at the time there were no Stewards in the room. He said he went to his car to get 2 riding pads he required to ride in a race. When questioned by the committee Mr Waddell said his car was 25 metres away from the back door of the jockey’s room and he took 90 seconds to retrieve his gear.
Mr Waddell further expressed his concerns that Trainers were entering the jockeys room and none of them had been charged.

Reasons for Decision:

The committee carefully considered all of the evidence presented. While we concede Mr Waddell did leave the jockeys room, he did attempt to gain permission from the Stewards. The committee firmly believes had Mr Williamson interviewed Mr Waddell prior to laying the charge an appropriate penalty should have been a warning. The key reasons for our decision are Mr Waddell had attempted to gain permission from the Stewards, he left the jockeys room for only 90 seconds and the car was only 25 metres away.
We reminded Mr Waddell of obligations and imposed a warning on him. He was told any future charge under this rule would result in a fine, which he acknowledged.
