We find the breach proved.
Penalty:
We suspend Mrs Anderton from the end of racing today up to and including 25 August. This is 2 amateur riding days. She is also fined the sum of $100 and is reminded of her professional obligations.
Charge:
Mr Davidson alleged that Mrs C Anderton allowed her mount (WAGONWHEEL) to shift in over the final 250 metres hampering HYDROGEN (Mr S Wenn).
Facts:
The videos demonstrated that Mrs C Anderton allowed WAGONWHEEL to lay in over the final 250 metres hampering HYDROGEN which was placed in restricted room and was buffeted.
Reasons for Decision:
Mrs Anderton admitted the breach.
Submissions for Penalty:
Mr Davidson stated the breach arose out of what appeared to him to be the respondent’s competitive nature and in her trying to do her best for the connections of the horse. That said, he emphasised her riding was careless.
Mr Davidson produced the respondent’s record, which was clear as she had only recently returned to race riding. He submitted that a penalty of 2 days suspension together with a small fine was appropriate.
Mrs Anderton did not disagree with this although she said she did intend to ride at the next meeting where there was an amateur riders' race, which was Wingatui on 17 August.

We are satisfied that a suspension is appropriate for this breach, which has resulted in the relegation of Mrs Anderton’s mount from 1st to 2nd. The connections of WAGONWHEEL and those that invested on the horse to win have thus been clearly disadvantaged. We note that she never stops riding nor does she attempt to straighten her mount.
On the other hand, the respondent has readily admitted the breach and has an excellent record, but this is tempered by the fact she has only very recently returned to race riding.
