Facts:

Mr Ydgren, stipendiary steward, alleged that CRUSH was not in its correct gait when it crossed the finishing line and was lapped on by a number of runners.  Judge’s placings were:
1st 2 AQUINAAH
2nd 4 CRUSH
3rd 10 RAKAUDI
4th 6 MISS MILWAUKEE
5th 5 IMA LOCH
The margins were ½ neck, neck, ½ head.

Submissions for Decision:

Mr Ydgren had Mr Wallis, stipendiary steward, demonstrate that CRUSH galloped just prior to the winning post for some 15 to 20 metres. The horse regained its gait briefly before again breaking and galloping across the line.
 
Mr N Williamson, who stated he represented the connections of CRUSH, agreed with Mr Wallis’s interpretation of the video and, in particular, accepted that the horse was not in its correct gait when it crossed the line.

Reasons for Decision:

A black and white print of the finish was placed before this committee. This was not particularly clear but it demonstrated that the 3rd, 4th and 5th horses were lapped on to CRUSH when that horse crossed the line. CRUSH was accordingly relegated to 5th.
