Miss Haley alleged that in Race 3 horse number 6 DON’T NEED AN EXCUSE galloped in excess of 50 metres in the run home.
Miss Haley sought disqualification of DON’T NEED AN EXCUSE pursuant to r 1003(2).

Miss Haley demonstrated on the videos that DON’T NEED AN EXCUSE was not in its proper gait for approximately 55 metres in the home straight.
Mr Haines, a co-owner of DON’T NEED AN EXCUSE, viewed the videos and did not contest the protest.
Reasons for Decision:
After viewing the videos from the various angles, the Committee is satisfied that DON’T NEED AN EXCUSE was not in its proper gait for a distance in excess of 50 metres in the final 200 metres. DON’T NEED AN EXCUSE was free of interference at the time. The breaking horse regulations are clear in that the horse is deemed to be in breach of r 870(3) in that it has failed to promptly regain its proper gait.
